In this essay, I will analyse both these perceptions to argue that each crime's background should be carefully examined before deciding on what type of penalty is most appropriate.
On the one hand, there is an advantage of setting a clear level of punishment for each kind of crime. For example, some one must be sent to jail if they commit robbery or even be sentenced to death in case of killing innocent people. Obviously, this clear set of regulation is indeed very useful in terms of reducing crime rate in the society as the whole nation is all aware of the severe punishments they may have if daring to undertake inhumane and unlawful behaviors.
Nonetheless, merely applying fixed types of penalty to every crime case is unfair for the offender in certain situations. Specifically, analysis on each crime's intentionality as well as the convict's behavior must be carefully carried out to see the severity of each case before final decision is made. For instance, a serial murderer must be treated more seriously than a woman who unintentionally kills the rapist as a way of self defense.
