These days there are thousands of different laws in many countries and each of them has its own way to assign punishments to particular kinds of crime. However, sometimes those sentences do not fit the crimes, which is terribly unfair for people involving the case. Therefore, many people strongly believe that it is necessary to take the motivation and the circumstances of any specific case into account when judging it and I am not an exception.
To begin with, it is noticeable that crimes are more and more complicated than they are in the past .This leads to an inevitable consequence that laws can not be sufficient in providing reasonable punishments for every individual crime. For instance, when it comes to illegal drug using , criminals always come up with new kind of addictive substances ,which are so new that nobody can categorise them. As a result, the judge will have to decide to hand out a punishment by his own view or to release the accused because of lack of evidence.
In addition, each case has a unique circumstances or conditions relating to where the crime took root and the way that the law commiter react with those who are in charge of investigation. A good example of this is when we have to distinguish between murder and manslaughter. Obviously, although those two kind of crime are far different in terms of seriousness , the boder between them is usually blurry. If we keep using the infexible rules in the way we judge crimes , there will be a lot of mistakes made.
However, considering the motivations and conditions of each case require a changeable view of some individuals, which are sometimes not really relieable. The most smart and faithful judge can make the most terrible wrong decision, let alone those who are young and unthoughtful. Moreover, sometimes we also read or hear of some criminals who is also the man that took responsibility for assigning hunderds of crimes .This stirs up a question among us that how we can account on a government that allows judges to make decision on his own without any supervison.
In conclusions, in some cases deciding on the punishment with consideration of motivation and condition of crimes is risky , especialy when the judge is not reliable. However, keep using rigid rules and ignore all other sides of problems just deteriorates them. In my opinion, we still need to consider those aspects carefully and try our best to give that kind of power to trustworthy people.In this way, we can minimize our mistakes down to the least and bring justice to as many citizens as possible.
